By accessing to and using Fitsjob.com, you (“You” “Your” or “Customer”) accept the Terms of Service and agree to abide by the rules governing the use of services offered by Fitsjob.com (“Agreement”).
Fitsjob.com Services
Fitsjob.com (“Fitsjob.com”, “we”, “our” or “us”) is an online recruitment web site. Job seekers can look for work and can make resumes. We also prepare the tools that it is necessary to look for the work that is most suitable for yourself. On the other hand, Employers can post jobs and can search resumes. We also prepare the tools that it is necessary for employers to look for most suitable persons for your company.
The service offered by Fitsjob.com.
To have the full use of services offered on the Website, you need to sign up to create an account and provide Fitsjob.com with certain personal information including but not limited to your email address for further communications between you and Fitsjob.com. By signing up, you agree to receive our newsletters, emails and other communications about our products or services. Any your personal information that you submit will be treated in accordance with the Privacy Policy of Fitsjob.com.
You might order the services or products at the quotations that are made available on Fitsjob.com and your orders shall be subject to the Website’s acceptance in full or in part of your orders. Fitsjob.com’s acceptance shall be in effect after your payment has been made or identified.
The Company shall reserve the right to make changes to its services, products, pricing models and prices from time to time as it considers appropriate.
We reserves the right to refuse to provide services to individuals, companies and organizations which, in accordance with the laws or at our own discretion.
If you applicable below articles, we refuse to provide service.
1.Have business in the same industry with us, including but not limited to, employment service, recruiting activities via e-commerce website, application and/or website, application providing e-commerce service (e-commerce trading floor).
2.Operate and manage websites or application related to recruitment or employment service similar to the us for business purpose or gaining profit.
3.To exploit, to use any information provided by the our services not for his/her/their own recruitment purpose.
4.Provide the services which are directly or indirectly competitive with existing services of us.
Purchased Services and Payment
1.You may order one or more of the services available in the List of Fitsjob.com Services by Purchase Order and/or Service Agreement.
2.Fitsjob.com Services are pre-paid or post-paid via cash, or bank transfer.
Your service fee is due by the payment date on your Purchase Order.
If your payment is past due, your service will be suspended until payment is made and your account is brought current.
3.We will issue a VAT Invoice in accordance with the applicable laws of Vietnam upon your request. You are responsible for the accuracy of the information used for the VAT Invoice.
Provision for Use of Services
1.After you have paid the Service Fee and/or activate the Purchased Services, we will not accept any requests to terminate or cancel the Purchased Services, refund the Service Fee or change any service..
2.You will create your own account with username and password to use the services on Fitsjob.com.
3.You are entitled to post your recruitment advertisement. It is your responsibility to ensure the accuracy and legality of all these contents.
4.You must activate the Purchased Services before their expiry date. You cannot activate any unused Services once they have expired.
User Rights and Responsibilities
Access to Fitsjob.com.
You are responsible for providing yourself with all hardware, software, telephone or other communications equipment and/or service to connect to the Internet and access Fitsjob.com as well as all Internet access charges, telephone charges or other fees or charges incurred in connecting to the Internet and accessing Fitsjob.com.
User Conduct.
By using Fitsjob.com Services and accessing Fitsjob.com, you understand that it is materialprohibited to:
1.Protest the State of Vietnam, destroy the unity of the nation, propagandize, distort, provoke or provide information against Vietnamese Government;
2.Provoke violation, war, aggression among nations and people, excite obscene, depravation, crime, social evils or superstition, ruin the nation's traditions and customs;
3.Disclose state secretes, military, security, economic, external relation and other secrets provided for by the laws;
4.Distort, slander, libel or offend the prestige of entities, the honor, dignity or prestige of individuals;
5.Introduce and propagate products and services prohibited by the laws;
6.Mention issues related to the politics and religions;
7.Use uncultured words that violate code of ethics and traditional culture of Vietnam;
8.Restrict or inhibit any other User/Customer from using and enjoying the Interactive Features;
9.Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national, or international law;
10.Post or transmit any information, software, or other material which violates or infringes in the rights of others, including material which is an invasion of privacy or publicity rights or which is protected by copyright, trademark or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or right holder;
11.Post or transmit any information, software or other material which contains a virus or other harmful component;
12.Alter, damage or delete any Content or other communications that are not your own Content or otherwise interfere with the ability of others to access Fitsjob.com;
13.Disrupt the normal flow of communication in an Interactive Area;
14.Claim a relationship with or to speak for any business, association, institution or other organization for which you are not authorized to claim such a relationship;
15.Conduct any act of cyberattack, cyber terrorism, cyber espionage and cyber crimes; causing breakdown, attacking, infiltrating, overriding, interfering with, disrupting, paralyzing or sabotaging information systems.
16.Use the Website for any illegal purpose, including but not limited to conspiring to violate laws and any operating rule, policy or guideline of the Internet access provider or online service.
Mass registration and automation.
Accounts that are registered automatically and/or systematically in mass, at the Company’s sole discretion, will be considered as breach will be dealed with as regulated in this Terms of Service.
Improper purposes.
Any act of abusing and/or using Fitsjob.com that deviates from the purpose of recruitment or employment opportunity seeking, at the Company’s sole discretion, will be considered as breach will be dealed with as regulated in this Terms of Service.

The Sites are intended for individuals seeking employment and for employers or recruiters seeking candidates for employment. You may use the Sites only for lawful purposes within the stated context of We intended and acceptable use of the Sites.
The Sites, We and all right, title and interest in and to the Sites and We are the sole property of We or its licensors, and are protected by Social Republic of Vietnam and foreign copyright, trademark and other laws.
Except for the limited licenses expressly granted to you in these Terms of Service, We reserves for itself and its licensors all other rights, title and interest.
Without limitation on the foregoing, you may not reproduce, modify, display, sell, or distribute the Content or We, or use them in any other way for public or commercial purpose. Notwithstanding anything to the contrary contained herein, this prohibition includes: (a) copying or adapting the HTML code used to generate web pages on the Sites; (b) aggregating, copying or duplicating in any manner any of the Content or information available from any of Our Sites, without the express written consent of We. You must retain all copyright, trademark, service mark and other proprietary notices contained on the Content or We on any authorized copy you make of the Content or We All other product and service marks contained on the Sites are the trademarks of their respective owners.
License to Use by Users who are Job Seekers.
We hereby grants you a limited, terminable, non-exclusive right to access and use the Sites only for your personal use seeking employment opportunities for yourself. This authorizes you to view and download a single copy of the material on the Sites solely for your personal, noncommercial use. You agree that you are solely responsible for the content of any Document you post to a Site and any consequences arising from such posting. Your use of the Sites is a privilege. We reserves the right to suspend or terminate that privilege for any reason at any time, in its sole discretion.
Use of Aggregate Data.
You understand and agree that We owns and has the right to collect, extract, compile, synthesize, and analyze Aggregate Data. We may use such Aggregate Data for any lawful business purpose without a duty of accounting to you, provided that the data and information is used only in an aggregated and anonymized form so that it cannot be identifiable as relating to you, your Company or to any other Job Seekers. "Aggregate Data" means de-identified aggregated data or information regarding Job Seekers' educational or career history (including, by way of example and not limitation, aggregate data relating to Job Seekers' occupation, location, salary, education and experience).
Other Specific Rules Regarding Site Usage.
You represent, warrant and agree that you(a) will not use (or plan, encourage or help others to use) the Sites for any purpose or in any manner that is prohibited by these Terms of Service or by applicable law. It is your responsibility to ensure that your use of the Sites complies with these Terms of Service and all applicable laws.

You understand that except for Content, products or services expressly available at Fitsjob.com, neither Fitsjob.com, manages, provides, or are responsible for any Content, goods or services available through sites on the Internet linked to or from Fitsjob.com.
Disclaimers Of Warranties
Fitsjob.com not warrants for any harm resulting from downloading or accessing any information or material on the Site or on other sites or services on the Internet accessed through the Site. Under no circumstances shall Fitsjob.com not warrants to your or any third party's any harm resulting on account of your use or misuse on the Site. And, under no circumstances shall Fitsjob.com not warrants to you or any third party on account of your use or misuse on any third party site you link to from Fitsjob.com’s Site.
Limitations of Liability
Fitsjob.com shall not be liable for indirect, incidental, special,exemplary, punitive, or consequential dameges, including lost profits and lost data, in connection with, or othrerwise resulting from any use of the services, regardless of the negligence of Fitsjob.com.
Under no circumstances shall Fitsjob.com not be liable to you or any third party on account of your use or misuse on any third party site you link to from Fitsjob.com’s Site.
Compliance and Dealing with Breach
You must comply with the Terms of the Purchase Order, Service Agreement and Terms of Service as a prerequisite for using the Services. If you fail to comply with any of the provisions in the Purchase Order, Service Agreement and Terms of Service, we may remove your posting, contents or links or remove, deactivate your Fitsjob.com account if necessary and suspend and/or terminate your service without refunding the Service Fee or any unused portion thereof. We also may claim compensation for any damages or losses arising from your breach.
Indemnity
You agree to indemnify and hold Fitsjob.com, its parent or subsidiary companies and their affiliates, and their respective directors, officers, employees, and agents safe and harmless from any and all liabilities, claims and expenses, including reasonable attorneys fees, arising from breach of this Agreement, any other policy, your use or access of Fitsjob.com or any Internet site linked to or from Fitsjob.com, or in connection with the transmission of any Content on Fitsjob.com.
Confidentiality
You agree that the confidentiality of the information relating to Services, transaction proceedings and/or any information gained during the course of use must be ensured. You will cooperate to stop and prevent any third party from the illegal reproduction and use of the posting contents or other information on the Internet.
You are not allowed to disclose, share or sell information about the candidates to any third parties under any methods without the Company’s prior consent in writing.
Miscellaneous
Amendments to this Agreement and Changes to Sites.
We may revise these Terms of Service at any time by updating this page. Changes will be binding on you on the date they are posted on the Sites (or as otherwise stated in the any notice of such changes). Any use of a Site will be considered acceptance by you of the then-current Terms of Service (including any exhibits thereto) contained on such Site. If at any time you find the Terms of Service unacceptable, you may not use the applicable Site any longer. Any new or different terms supplied by you are specifically rejected by We unless We agrees to them in a signed writing specifically including those new or different terms. We may change the Sites at any time.
